Welcome to www.dropdeadshy.me (the “Website”), operated by DropDeadShy Photography, based in Oahu, Hawaii. By accessing or using this Website, submitting an inquiry, booking services, or making any purchase, you agree to be legally bound by the following Terms & Conditions.
If you do not agree, discontinue use immediately.
1. Ownership & Intellectual Property
All content on this Website — including but not limited to photographs, text, graphics, logos, branding, layout, design elements, and digital downloads — is the exclusive intellectual property of DropDeadShy Photography unless otherwise stated.
All photographs are protected under United States Copyright Law (Title 17, U.S. Code).
You may NOT:
Screenshot, download, copy, reproduce, edit, crop, filter, alter, or distribute any image
Use images for commercial, promotional, or monetary purposes
Submit images to blogs, publications, vendors, or third parties without written permission
Remove watermarks or copyright metadata
Unauthorized use constitutes copyright infringement and may result in legal action and statutory damages.
2. Creative Control & Artistic Discretion
By booking services or hiring DropDeadShy Photography, you acknowledge and agree:
The photographer retains full creative control over composition, posing, lighting, editing style, image selection, and final delivery.
Editing style, tone, color grading, and retouching decisions are made at the sole discretion of the photographer.
Unedited RAW files are never delivered under any circumstances.
Requests for style changes inconsistent with the photographer’s portfolio may be declined.
Creative dissatisfaction based on personal preference does not constitute breach of contract.
3. Booking, Retainers & Payments
A signed contract and paid retainer are required to reserve a session date.
Retainers are non-refundable and non-transferable.
Session dates are not secured without payment.
Remaining balances must be paid by the deadline stated in the contract.
Failure to complete payment may result in cancellation without refund.
All payments made through this Website or associated platforms are final unless otherwise stated in writing.
4. Model Release & Promotional Use
By signing a contract and participating in a session with DropDeadShy Photography, the Client grants full and irrevocable permission for DropDeadShy Photography to use photographs, video footage, and recorded behind-the-scenes content from the session for portfolio, website, social media, publication submissions, marketing, advertising, promotional, and educational purposes.
This includes, but is not limited to:
Website galleries
Social media platforms
Printed marketing materials
Studio samples
Blog features
Publication submissions
Behind-the-scenes video content
No additional compensation will be provided for such usage.
If the Client wishes to withhold image usage for promotional or marketing purposes, a signed Privacy Agreement and applicable Privacy Fee must be paid prior to the session date. Privacy is not implied and must be formally secured in writing.
Absent a signed Privacy Agreement and paid Privacy Fee, the Model Release is automatically granted and enforceable.
5. Digital Delivery & File Responsibility
Client galleries are delivered electronically.
Clients are solely responsible for:
Downloading images within the provided timeframe
Backing up images in multiple secure locations
DropDeadShy Photography is not responsible for lost, deleted, corrupted, or damaged files once delivery has been completed.
Archival of client files is not guaranteed beyond the stated delivery window.
6. Complimentary Items
Complimentary items (including prints, bonus images, or promotional products) are provided as courtesy additions and hold no cash value.
They are not refundable, replaceable, or guaranteed.
7. Limitation of Liability
DropDeadShy Photography shall not be liable for:
Technical failures of hosting platforms or third-party services
Website downtime or software malfunctions
Acts of God, weather events, illness, government restrictions, or circumstances beyond reasonable control
Indirect, incidental, emotional, reputational, or consequential damages
Maximum liability for any claim shall not exceed the total amount paid for the specific service giving rise to the claim.
8. Third-Party Platforms
This Website may link to third-party booking systems, gallery hosts, payment processors, or social media platforms.
DropDeadShy Photography is not responsible for the policies, data handling, or technical performance of third-party services.
Use of those platforms is at your own risk.
9. Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of the State of Hawaii.
Any disputes shall be resolved exclusively in the courts located in Hawaii. You waive the right to bring claims in any other jurisdiction.
10. Indemnification
You agree to indemnify and hold harmless DropDeadShy Photography from any claims, damages, liabilities, or expenses arising from:
Your misuse of Website content
Your breach of these Terms
Unauthorized use of delivered images
11. Modifications
DropDeadShy Photography reserves the right to update these Terms & Conditions at any time without prior notice.
Continued use of the Website constitutes acceptance of any changes.
